Introduction

POWAIR6 is committed to respecting the confidentiality and protection of personal data in accordance with the General Data Protection Regulation (GDPR – EU Regulation 2016/679), French Law No. 78-17 of 6 January 1978 as amended (« Informatique et Libertés »), and Article L34-5 of the French Postal and Electronic Communications Code.

Personal data collected

POWAIR6 collects the following personal data as part of its e-commerce activities:

  • First name and surname
  • Postal address
  • Email address
  • Phone number
  • IP address and browsing data
  • Payment and billing data
  • Order history and customer service interactions

Purposes of processing and legal bases

Personal data collected is used for the following purposes:

  • Order processing and delivery placed on our website (legal basis: performance of the contract – Art. 6.1.b GDPR);
  • Customer relationship management (questions, complaints, after-sales service) (legal basis: performance of the contract – Art. 6.1.b GDPR);
  • Invoicing and bookkeeping (legal basis: legal obligation – Art. 6.1.c GDPR);
  • Fraud prevention and transaction security (legal basis: legitimate interest – Art. 6.1.f GDPR);
  • Electronic communications (transactional and marketing) – see dedicated section below;
  • Compliance with legal and regulatory obligations (legal basis: legal obligation – Art. 6.1.c GDPR).

Electronic communications

POWAIR6 sends you two categories of electronic messages:

1. Transactional communications

On the basis of contract performance (Art. 6.1.b GDPR), POWAIR6 sends you the messages necessary for the management of the relationship: order confirmation, delivery tracking, invoicing, after-sales service, account security. These messages cannot be opted out of as long as an order or active account is ongoing.

2. Marketing communications

In accordance with Article L34-5 of the French Postal and Electronic Communications Code, POWAIR6 may send you marketing communications covering in particular: commercial offers, product news, usage tips, editorial content about airsoft practice, and more generally any message promoting directly or indirectly the products, services or image of POWAIR6.

 

If you are a customer: these communications relate to products or services analogous to those you have purchased. You may object at any time, in a simple and free manner, via the one-click unsubscribe link present in each message. POWAIR6 undertakes to give immediate effect to any unsubscribe request. Legal basis: Article L34-5 of the French Postal and Electronic Communications Code and POWAIR6's legitimate interest in promoting products and services analogous to those purchased by its customers (Art. 6.1.f GDPR).

 

If you are a prospect (non-customer): such communications are sent to you only after collection of your prior, explicit and revocable consent. Legal basis: consent (Art. 6.1.a GDPR).

 

If you are a professional: on the basis of POWAIR6's legitimate interest in promoting products and services related to your professional activity (Art. 6.1.f GDPR), communications may be sent to you. You may object at any time via the unsubscribe link present in each message.

 

A one-click unsubscribe link is included in every marketing message. Unsubscription applies to all marketing communications (offers, news, tips, editorial content). A preference centre may also be offered to fine-tune the topics received.

Data access and recipients

POWAIR6 only shares users' personal data with third parties necessary for service performance:

  • Logistics providers and carriers (delivery);
  • Payment service providers (PayPal, Mollie, Alma and any banking institution involved in the transaction);
  • IT providers and hosting providers;
  • Consent / cookie management providers (Axeptio);
  • Marketing email and CRM tools;
  • Administrative or judicial authorities where required by law.

No other third party has access to the data without users' explicit consent.

Data retention

POWAIR6 applies the principle of data minimisation by distinguishing several retention regimes according to purpose:

 

Active database — customer account and marketing data: duration of the contractual relationship, then 3 years from the Customer's last active contact. An active contact includes: any order, login to the Customer Account, opening or click on an email sent by POWAIR6, or interaction with customer service. Before the expiry of this period, POWAIR6 may send the Customer a reactivation message allowing them to express their wish to continue receiving communications. In the absence of a response, the data is removed from the active database.

Intermediate archiving — order and invoicing data: 10 years from the closing of the relevant accounting year, in accordance with Article L123-22 of the French Commercial Code, Article L102 B of the French Tax Procedures Code, and to enable the Seller to assert or defend its rights in the event of a dispute (Article L110-4 of the French Commercial Code). This data is kept with restricted access and is no longer used for commercial purposes.

At the end of the archiving period: data is either deleted or irreversibly anonymised. POWAIR6 may retain in anonymised form the statistical data necessary for its long-term commercial analyses; anonymised data is no longer considered personal data within the meaning of the GDPR.

Consent and objection records: 5 years from collection, for evidentiary purposes.

Connection data and technical logs: 1 year, in accordance with applicable regulations.

Cookies and trackers: maximum 13 months from deposit on the user's device; data collected via these cookies is retained for a maximum of 25 months.

User rights

In accordance with the GDPR, you have the following rights regarding your personal data:

  • Right of access to your personal data;
  • Right of rectification in case of inaccurate or incomplete data;
  • Right to erasure ("right to be forgotten");
  • Right to restriction of processing;
  • Right to data portability;
  • Right to object to processing, in particular for marketing purposes;
  • Right to withdraw consent at any time, without affecting the lawfulness of prior processing;
  • Right to set directives regarding the fate of your data after your death.

Data security

POWAIR6 has implemented appropriate technical and organisational security measures to protect users' personal data against unauthorised access, loss, destruction or alteration (encryption, access controls, secure hosting, logging).

Transfer of data outside the EEA

POWAIR6 does not transfer user data outside the European Economic Area (EEA). If such a transfer were to prove necessary, it would be carried out in compliance with the requirements of the GDPR and appropriate legal mechanisms (adequacy decision, standard contractual clauses, etc.).

Notification in the event of a data breach

In the event of a personal data breach posing a risk to the rights and freedoms of data subjects, POWAIR6 undertakes to inform the competent supervisory authority (CNIL) as well as the users concerned within a maximum of 72 hours after becoming aware of it, in accordance with Articles 33 and 34 of the GDPR.

Use of cookies

POWAIR6 uses technical cookies necessary for the operation of the site, as well as statistical and personalisation cookies. A cookie banner, managed via the Axeptio solution, informs users on their first visit and allows them to accept or refuse non-essential cookies.

 

Consent. The user expresses consent to non-essential cookies through a clear and positive act (clicking an "Accept" button).

 

Your rights. You can manage, modify or withdraw your consent to cookies at any time by changing your browser settings or via the cookie management banner available on the site.

 

Cookie provider. The consent management banner is edited by Agilitation (axeptio.eu), a SAS with share capital of €76,130, registered office at 15 rue du Général Campredon, 34000 Montpellier, registered with the Montpellier RCS under number 821 947 009, Intra-Community VAT FR62821947009.
